In light of the novel COVID-19 pandemic, NJAMHAA will host a 1-hour webinar on Wednesday, May 6th @ 12pm The webinar will cover the following in the context of COVID-19:

* OCR’s HIPAA Q&A published March 24 covering when disclosures to law enforcement, paramedics and first responders are allowed

* OCR’s March 17 Notice to exercise HIPAA enforcement discretion in connection with use of certain telehealth apps

* New NJ law (A3680 and A3682) signed into effect March 20 which establishes certain requirements to use telehealth to respond to COVID-19

* Other actions being taken by the State of New Jersey Departments to expand access to telehealth and tele-mental health including, among other things, requiring certain payors to cover the costs of such services.

* HHS’s February 2020 HIPAA Bulletin summarizing provisions of HIPAA which support sharing of PHI when there is a public health emergency

* The New Jersey Emergency Health Powers Act, N.J.S.A. 26:13-1 et seq., which has been triggered by Governor Murphy issuing a declaration of a public health information in New Jersey

* Enforcement Discretion permitting HIPAA BA vendors to share COVID-19 related PHI directly with Public Health Agencies, and for health care oversight
